Mike is a seasoned trial lawyer and counselor who represents individuals and entities on a variety of complex legal matters including commercial litigation, contracts, data privacy issues, insurance litigation, breach of fiduciary duty, tort litigation, environmental remediation and litigation, business law, real estate litigation, employment disputes, and disputes arising out of corporate transactions.
Mike has successfully served as trial counsel for clients in high-stakes, “bet-the-company” litigation and has substantial experience in state and federal courts, arbitrations, and appeals.
In addition to the courtroom, Mike also serves his clients as outside general counsel where he provides ongoing legal support for a variety of businesses across numerous industries.
Representative Litigation Matters
- Merx Global v. Nurture Life: obtained complete defense verdict for growth-stage business defeating claims brought by a large investor alleging improper share conversion during funding rounds.
- Confidential Privacy Litigation: obtained dismissal of all claims alleged against online genealogy business under Genetic Information Privacy Act.
- Confidential Employment Litigation: defeated all claims asserted by former employee including claims for alleged unpaid bonuses, age and sex discrimination.
- Crypto Infinity v. EZ Blockchain Services: obtained complete defense jury verdict after multi-week trial in a $15 million dispute involving claims for fraud and breach of contract in the cryptocurrency industry.
- Confidential Commercial Arbitration: obtained complete defense verdict after weeklong arbitration involving multimillion dollar claims for fraud, product defect, and breach of warranty related to data centers.
- Rizer et al. v. Illinois Land Investors I, LLC et al.: obtained dismissal of all claims concerning alleged decades-long scheme to defraud involving real estate investment.
- Auge et al. v. Stryker et al.: obtained favorable settlement for plaintiff after three-day jury trial in federal court related to claims for unpaid royalties and unjust enrichment arising out of medical instrument improvements.
- EZ Blockchain LLC v. Blaise Energy et al.: obtained preliminary injunction on emergency basis securing more than $5 million in equipment from potential dissipation.
- Jagoe v. Huizenga Capital Management: obtained summary judgment on all claims in favor of plaintiff and defeated all counterclaims in breach of contract dispute concerning equity ownership as a function of carried interest.
- PsycHealth v. Family Health Network, Inc.: obtained dismissal of all claims in “bet-the-company” arbitration concerning allegations of improper medical billing.
- McGuinness v. Schrepfer: obtained jury verdict in personal injury action in Circuit Court of Cook County. Defendant’s final pre-trial offer was $0.
Representative Appellate Matters
- Swarthout et al. v. William Ryan Homes, Inc. et al.: obtained reversal of trial court’s refusal to vacate jury verdict entered against client. Following appeal, judgment was vacated and new judgment entered in client’s favor for full amount plus attorneys’ fees.
- Sullivan et al. v. Martinez et al.: obtained reversal of trial court’s decision denying request for arbitration and requiring production of books and records.
- Title Industry Assurance Company, R. R.G. v. First American Title Insurance Company, et al.: obtained favorable ruling on appeal to the Seventh Circuit regarding insurance coverage under errors and omissions policy in connection with a fraudulent lending scheme resolving several interrelated lawsuits then pending in state and federal courts.
Representative Outside General Counsel Matters
- Serve as factional general counsel for global online auction platform that facilitates $2B+ in transactions annually.
- Serve as fractional general counsel for nationwide data center business in variety of areas including commercial matters, employment, contracting, intellectual property, and litigation.
- Counseled nationwide additive manufacturing company pre-IPO (valued at $1.4B) in support of ongoing business operations in variety of legal areas including commercial matters, real estate, employment, and restrictive covenants.
- Regularly assist entrepreneurs with various legal needs including corporate formation, IP protection, and various commercial matters.
Representative Class Action and MDL Matters
- In re COVID-19 Business Interruption Insurance Coverage Litigation and In re Generali COVID-19 Travel Insurance Litigation: represented putative class representatives in first-filed Covid-related insurance coverage disputes, including argument before the Judicial Panel on Multidistrict Litigation.
- Trottier v. Attendance on Demand, Inc.: obtained favorable settlement of all claims in Biometric Information Privacy class action.
- Confidential BIPA matter: obtained dismissal of all third-party claims in Biometric Information Privacy Act class action litigation in favor of privately-held company offering time and attendance solutions.
- Confidential BIPA matter: obtained dismissal of all claims in Biometric Information Privacy Act class action litigation in favor of privately-held company offering cloud-based workforce management solutions.
- In re Juul Labs, Inc. Marketing, Sales Practices and Products Liability Litigation: representation of retailers and dealers of Juul products in connection with nationwide multidistrict litigation now pending in the Northern District of California.
- Confidential Products Liability Class Action Matter:represented nationwide group of automotive powersports dealers in connection with product liability dispute involving off-road vehicles.
