Michael KozlowskiMike is a litigator who counsels individuals and entities on a variety of complex litigation matters including commercial litigation, insurance litigation, class actions, data privacy litigation, environmental litigation including CERCLA, RCRA, and OPA, breach of fiduciary duty, disputes arising out of corporate transactions, and business law. He has successfully served as trial counsel for clients in high-stakes litigation and has experience in both state and federal courts.

Mike leverages his complex litigation experience and serves as outside general counsel to several businesses in a variety of industries.

While in law school, he volunteered to provide legal help to disadvantaged women working with the Illinois College of Law’s Domestic Violence Legal Clinic. In addition to serving as a teaching and research assistant throughout law school, Mike is a graduate of the Mirza Trial Academy.

  • Outside General Counsel: Counseled nationwide data center business in a variety of areas including, commercial matters, employment, contracting, real estate issues, and intellectual property, in support of multiple business lines including sale of data centers and ongoing operations.
  • Outside General Counsel: Counseled nationwide additive manufacturing company pre-IPO (valued at $1.4B) in support of ongoing business operations in variety of legal areas including corporate governance, employment, non-competes, real estate transactions, contracting, and commercial matters.
  • In re Juul Labs, Inc. Marketing, Sales Practices and Products Liability Litigation: Representation of retailers and dealers of Juul products in connection with nationwide multidistrict litigation now pending in the Northern District of California.
  • Jamerson v. Cedarhurst et al.: Obtained dismissal of all claims against time and attendance service provider in class action suit alleging violations of Illinois’ Biometric Information Privacy Act.
  • Confidential Products Liability Class Action Matter: Represented nationwide group of automotive powersports dealers in connection with product liability dispute involving off-road vehicles.
  • PsycHealth v. Family Health Network Inc.: Second-chaired “bet-the-company” commercial arbitration including cross examination of opposing expert, which was cited by the three-judge panel in its decision denying opponent’s counterclaim and awarding client millions in contract damages.
  • McGuinness v. Schrepfer: Won jury verdict in personal injury lawsuit in the Law Division of Circuit Court of Cook County. Defendant’s final pre-trial offer was $0.
  • Confidential Non-Compete Matter: Achieved favorable settlement on behalf of key employee against former employer seeking to enforce a non-compete agreement, resolving lawsuits pending in multiple federal courts. According to the client, the settlement result was better than any result that could have been achieved in litigation.
  • Quercia et al. v. Elenka, USA et al.: Defeated request for preliminary injunction related to alleged fraud and breach of fiduciary duty of corporate officer.
  • Confidential Commercial Dispute: Obtained a favorable settlement on behalf of business owner engaged in dispute with contractual counterparty regarding amounts allegedly due under the contract. Parties settled for less than a third of plaintiff’s initial demand.
  • Title Industry Assurance Company, R. R.G. v. First American Title Insurance Company, et al.: Obtained favorable ruling on appeal to the Seventh Circuit regarding insurance coverage under errors and omissions policy in connection with a fraudulent lending scheme resolving several interrelated lawsuits then pending in state and federal courts.
